银行履约保函

二、独立担保

II. Independent Guarantee

1. Nature: This is an independent service provided by the bank and is unrelated to the letter of credit transaction. It is a letter issued by the bank to the beneficiary, guaranteeing the performance of the contract obligations by the applicant (buyer).

2. Issuance: The independent guarantee is usually issued by the applicant's bank to the beneficiary upon the request of the applicant.

3. Scope of Application: Independent guarantees are applicable to various types of trade contracts, such as sales contracts, construction contracts, and lease contracts. They can assure the applicant's timely payment, performance, or compensation for losses.

4. Legal Effect: The independent guarantee has an independent legal effect and is not subject to any other contract. This means that even if the trade contract is canceled or modified, the independent guarantee remains valid, and the bank is still obligated to honor its guarantee.
